Hello, (not native english speaker here)

I am making a close-sourced commercial indie game. I have a few questions about asset licenses, after having read quite a lot on the matter (including the FAQ).

I understand that both CC-BY-SA and GPL licenses are problematic to use in a close-sourced commercial game, because it is unclear whether the sharealike clause applies only to the art piece being used, or to the whole project, even though there is a legal separation between the source code and the art.

However, if I ask the artist directly for clarification, and the person allows me to use the asset, then it is okay.

So, I would like to know :

1. What kind of proof do I need that I received permission from the artist (in case there is a protest afterwards) ? I found in this forum that I need to sign a Release Agreement, but the definition of the thing doesn't seem to match : "Release Agreements are normally signed after there has been some sort of incident that damages one party (the damage can be physical or financial or other damage) and the party would like to "release" the other party from liability in exchange for something, usually money". I don't know if keeping a copy of an email is sufficient. How do you people usually proceed ?

2. I would like to exclusively use assets from OGA, especially from the Liberated Pixel Cup where all the assets are dual licensed under CC BY-SA 3.0 and GPLv3. I understand this means I can choose whichever license I prefer, but I would like to ask OGA for authorization. Does OGA have the authority to allow me to use the CC-BY-SA assets from the website for my game ? Or do I have to contact every artist individually ?

3. I have read that CC-BY-SA is safe for open-source non commercial games, but NOT safe for commercial games. Is it only because commercial games are close-sourced so they cannot release their entire project under an open source license ?

 

Thank you for your patience. Once my game is made, I will publish my modified versions of the assets and consider making donations based on the game's success. I just want to be sure that I can use the assets.
