I think that it would be more convincing to keep the head the same color as the body.
It's a skull helmet. if you look at the 3d model you will see it's raised.
The preview looks AWESOME, really professional and very creative!

Don't know what WOTC is, and this model is probably 2 years old. and I made it from my on imagination. I also didn't name it.
At least in the U.S., I can't find a trademark for Thri-Kreen. Although, IANAL.
Side note, I did find a dead trademark for Draconian. Data East had it. I guess they did a Dragonlance game with TSR back in the day?
Anyway, probably my fault for this thing being named a Thri-Kreen (that's just what it reminds me of). We can rename it if necessary.
Trademarks don't apply to generic names and it's impossible to copyright a name so call it whatever you want.
The defense of such a creation could be VERY difficult. If the original author could provide dev logs, progressive saves, concept art, etc, that would be beneficial. A signed statement swearing that he had no knowledge of the other creature would be nice as well.
If only every author had an automatic keylogger and screenshot grabber.
I'm the creator. and it's a couple years old, as stated above.
it wasn't that hard. and I'm not even a character designer. i rarely create 'organics'.
Dev logs... maybe 5-10 hours of work over 2 or 3 days. first the idea, then the modeling. the hardest part was unwrapping texturing. at last, animating (poorly).
Progressive saves, I rarely do that. this is all in 1 file.
no concept art. just a few minutes of someone giving me a basic idea concept. And then me googling some monsters/anime characters/insects.

I have no idea what "WOTC" or "IANAL" are. and still don't. Never heard of them or seen or played (don't know if it's a game or movie or whatever).

Also, I really think the whole 'sworn statement' is overdoing it. This is not a rip. That much is clear. It's already been renamed to avoid possible trademark issues. Can we move on now?

I like it! I'm going to try it in my AR monster-hunter style game. I might cook up a walk/stalk animation. BTW I like the skull helmet, it looks cool. As a suggestions for future work, I think what might help avoid the confusion mentioned by an earlier commenter about the skull-helmet is if the skull motif existed elswhere in the design, perhaps as skull knee-pads, or shoulder/elbow pads.
