It's CC-BY 3.0, which means that you may use it with the only restriction being crediting the author in a method appropriate to your medium. I do not require that you credit me, but you must credit AngryMeteor.com for the original graphic.
I disagree strongly with this. Having a lossless FLAC source file gives us as developers the flexibility to recode to the quality and format we require, losing as little quality as possible. It's relatively simple to go from a high quality source file to a lower quality file for integration using, say, ffmpeg or Audacity.
I like the "breathing" animations, especially. Could you post these as individual frames in a lossless format, though? GIF dithers badly which is not good for what I want to use these for.
Reading between the lines, it seems like he's milking it for cash- if he thinks they're making money, he threatens them to get his cut. In my opinion, that's a very selfish position to take- understandable, of course, but disappointing.
Never thought I'd see anything RWBY-related here. You should probably reword the title and description to clarify that this was originally created as a fan character for RWBY but otherwise carries no connection to the show.
The intro fades in extremely slowly, with no option to skip it or speed it up. Once it's finished fading in, it disappears almost instantly. This is a really irritating way to do it. It should fade in a little faster, perhaps coming in all at once on a mouse click, and stay on at the end and wait for a click or keypress.
The intro text itself is quite confusing. Who are the bad guys?
Moving is accomplished with WASD but firing is mapped to mouse buttons, which is incredibly awkward. Either give the game full mouse support or put everything on the keyboard. And please give us some way of remapping the controls. Controller support would be nice, too, but not strictly necessary.
The difficulty ramps up way too fast. I hadn't even figured out the controls when suddenly the screen was filled with enemies. Predictably, I died instantly.
The controls feel sluggish and awkward. This isn't a tangible thing, just a feel sort of thing.
The lasers fire too slowly to effectively combat the volume of enemies you're throwing at us.
I was confused about how the bombs and laser worked until I actually tried it.
The sound design seems a bit too retro for the graphics. The graphics feel 16-bit/90s, but the sound feels 8-bit/80s.
Speaking of the graphics, I recognize some of them from Tyrian. Not necessarily a bad thing.
It would be really nice to continue from where I left off after dying instead of having to start from the beginning of the level.
The concept of the game isn't bad, and in terms of actual work it seems to be mostly complete, but it really does lack polish.
On a side note, I feel this would work better as a mobile or browser game than a desktop one.
Both BSD licenses are open source by the broader definition. The original, 4-clause BSD license has an odd clause that makes it GPL-incompatible and I think prevents it from being approved by the FSF.

Ginza Medium is close, but not exactly right, and in any case non-free. I would wait for official word on this before making anything.

I forgot to mention this last time, but I couldn't figure out how to use bombs. They always went to the top of the screen, exploded, and did nothing.
Also, my specs (from Speccy):
Will this be open-sourced? I'm curious about how the engine is put together.
It needs a lot of polishing, in my opinion.

If there's interest, I'll try to track down public domain recordings of other famous (and maybe not so famous) pieces.
