There is a way to report potential problems for regular members: mark as spam. It shouldn't be the same as a licensing issue, but for now it is. Marking something as spam doesn't make it more likely to be caught by the spam filter or something, it just notifies me that it needs to be reviewed. The need for review could be related to spam or licensing issues. 

You're correct, it isn't ideal, but in the meantime, everyone should be using the spam button as a "this needs attention" button.

I agree; holding site hosts accountable for the actions of its users is concerning.

I have looked into it. I am not super familiar with EU law, and my review of the legislation is somewhat cursory, however I see a few things in the directive that tell me OGA has little to worry about:

  1. Site hosts are only penalized if they fail/refuse to correct for an infringing item. We have always been pretty responsive about taking down potential licensing issues. Even if we miss a submission with a potential problem, we handle it quickly as soon as we're notified. Our system of admin + community curation as well as rapid redress already puts us in compliance with the Directive.
  2. There are provisions to prevent unfairly hampering legitimate fair use and free expression. Beyond that, uploading works to platforms focused on "open source" and copyleft (aka OGA) are already exempted from the requirement to comply with copyright rules.
  3. Small and micro platforms (under which OGA would qualify) are exempted from the Directive.

Even if we had AI to identify licensing issues, we wouldn't report people to the authorities. Taking down infringing content and informing users is sufficient. We've never banned anyone for uploading copyrighted stuff anyway. Some people have been banned, sure, but that was for repeatedly shirking the rules after many warnings.

The rules on OGA are stricter than the EU Copyright Directive. Any artwork that would be disallowed by the Directive would already not be allowed here on OGA for similar copyright reasons. The legislation requires that platforms proactively work with rightsholders to stop users uploading copyrighted content. As OP well knows, we were already doing this. The Directive will effectively change nothing with regard to the images posted here.

TL;DR: we were rejecting unlicensed content before it was cool. :)

Yes, but you shouldn't notice anything different beyond improved response time hopefully. A lot of the updates and features we plan to do require newer server features, so Botanic and a few others are working on getting the whole site moved to a new server.
